1. GENERAL PROVISIONS
The administrator of personal data collected via the RWE Capital online platform (hereinafter referred to as the "Platform") is Piotr Szyndzielorz, operating within the framework of a non-registered activity (in accordance with Article 5 of the Polish Entrepreneurs' Law), residing in ul.Piastowska 22/1 47-200 Kędzierzyn-Koźle, Poland , email address: admin@rwecapital.net , hereinafter referred to as the "Administrator".
Personal data collected by the Administrator via the Platform are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as "GDPR").
The Administrator takes special care to protect the interests of data subjects, and in particular ensures that the data collected are processed lawfully, collected for specified, legitimate purposes, and not subjected to further processing incompatible with those purposes.
2. PURPOSE AND LEGAL BASIS OF DATA PROCESSING
Your personal data may be processed for the following purposes:
Implementation of the Artist Onboarding Process: Processing data submitted via the application form (name, email, portfolio links, artistic bio) to evaluate potential collaboration. (Basis: Article 6(1)(b) of the GDPR – processing is necessary for the performance of a contract or to take steps prior to entering into a contract).
Execution of Sales and Logistics: Processing data necessary to complete a purchase, including forwarding shipping details to the Artist or courier company to deliver the artwork. (Basis: Article 6(1)(b) of the GDPR).
Contact and Communication: Responding to inquiries submitted via the contact form or email. (Basis: Article 6(1)(f) of the GDPR – the legitimate interest of the Administrator).
Analytical and Statistical Purposes: Monitoring traffic on the Squarespace platform to optimize user experience. (Basis: Article 6(1)(f) of the GDPR – the legitimate interest of the Administrator).
3. PERIOD OF PERSONAL DATA STORAGE
Your personal data will be stored:
In the case of data processed for the performance of a contract (cooperation with Artists or sales) – for the duration of the contract and until the expiry of the limitation period for claims resulting from it.
In the case of data processed based on the Administrator's legitimate interest – until an objection is raised or the purpose of processing is achieved.
4. DATA RECIPIENTS
To ensure the proper functioning of the RWE Capital platform, the Administrator may share your data with:
Artists: In the event of a purchase, the buyer's shipping data will be shared with the respective Artist solely for the purpose of packing and shipping the artwork.
Hosting and IT Providers: Squarespace Ireland Limited, as the provider of the website infrastructure and database.
Payment Processors: Companies managing online payments (e.g., Stripe, PayPal), if a purchase transaction is initiated.
Courier and Postal Services: In order to deliver the purchased artwork to the Customer.
5. YOUR RIGHTS (DATA SUBJECT RIGHTS)
Every individual whose data is processed has the right to:
Access their personal data,
Rectify (correct) their data,
Delete their data ("the right to be forgotten"),
Restrict data processing,
Transfer data to another administrator,
Object to data processing based on the legitimate interest of the Administrator,
Lodge a complaint with a supervisory authority (President of the Personal Data Protection Office in Poland / Nuoz in Austria) if they consider that the processing violates the GDPR.
6. COOKIES AND ANALYTICAL TOOLS
The Platform uses cookies (small text files saved on your device) to ensure proper functioning, remember user settings, and collect anonymous statistical data.
The Platform is hosted on Squarespace, which uses functional and analytical cookies. The User can manage cookie settings directly in their web browser or via the consent banner displayed upon entering the Platform.
