TERMS AND CONDITIONS OF COOPERATION WITH ARTISTS WITHIN THE RWE CAPITAL PLATFORM

1. GENERAL PROVISIONS

  1. The RWE Capital platform, managed by RWE Capital in the form of a non-registered activity (in accordance with Article 5 of the Polish Entrepreneurs' Law), hereinafter referred to as the "Gallery", acts as an online intermediary in the sale of original works of art (paintings, sculptures, prints, etc.) created by independent Artists.

  2. An Artist within the meaning of these Terms and Conditions is a natural or legal person who has submitted an application via the registration form and has been positively verified by the RWE Capital team.

2. MODEL OF COOPERATION (DIGITAL CONSIGNMENT)

  1. The Gallery does not purchase the artworks from the Artist to own them. The artworks remain the property of the Artist and stay in their studio until the moment of sale to the final customer.

  2. The Artist grants the Gallery a non-exclusive right to present, promote, and offer for sale selected artworks on the RWE Capital website and its social media channels.

3. COMMISSION AND SETTLEMENTS

  1. The presentation of artworks on the RWE Capital platform is completely free of charge.

  2. The Gallery charges a commission of 30% of the gross price agreed mutually with the Artist for each sold artwork.

  3. The payment to the Artist (the sale price of the artwork minus the Gallery's commission) shall be made within 14 days from the date the customer confirms the receipt of the package (due to the consumer's statutory right to return goods).

4. LOGISTICS AND SHIPPING

  1. Upon the sale of an artwork, the Artist shall be notified immediately via email.

  2. The Artist undertakes to securely pack the artwork in accordance with fine art shipping standards and dispatch the courier package within 3-5 business days from receiving the notification.

  3. The shipping cost shall be covered by the Customer (Note: The customer pays at checkout, and the Gallery sends a pre-paid shipping label to the Artist).

  4. The Artist is obliged to include a signed RWE Capital Certificate of Authenticity in every shipment. The digital template for printing will be provided by the Gallery.

5. COPYRIGHTS

  1. The Artist declares that they are the sole owner of the moral and economic copyrights to the submitted artworks and that these works are free from any third-party claims.

  2. The Artist retains full economic copyrights to the artwork. The Gallery has the right to use photographs of the artworks exclusively for the promotional purposes of the RWE Capital platform.

6. FINAL PROVISIONS

  1. In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply.

  2. The Gallery reserves the right to make changes to these Terms and Conditions. Artists will be notified of any changes via email.
